Can I accept partial rent and still evict the tenant? Maybe….

In 2012,accepting money the North Carolina Legislature added a section in the holdover portion of the statute that states that as long as a lease provides that the landlord’s acceptance of partial rent or partial housing subsidy payment does not waive a tenant’s breach of the lease, the landlord may accept partial payments and still proceed with an eviction based upon monetary or non-monetary violations of the lease agreement. The revision also made it clear that accepting rent and moving forward with summary ejectment does not constitute an unfair and deceptive trade practice (which was the rule in residential cases previously).
